Thomas Partey has not been convicted of any crime. He remains entitled to the presumption of innocence, a principle that lies at the heart of every democratic justice system. This is not to suggest that Canada, or any other nation, is obliged to wait for a criminal conviction before refusing entry or denying a visa.
Canada's Immigration and Refugee Protection Act permits visa refusals on "reasonable grounds to believe"—a threshold lower than criminal conviction. That standard may be appropriate for immigration control. But when applied to a World Cup athlete who has not been convicted of any offence, it risks altering a global sporting competition on the basis of allegations that remain unproven. The question is not whether Canada can deny entry, but whether it should do so in circumstances that affect the competitive integrity and equal treatment that are essential to a World Cup.
None of this dismisses the seriousness of the allegations or the importance of protecting potential victims. But in the absence of a conviction or judicial finding, the principle of competitive integrity should counsel restraint.
This critical issue extends beyond one player, one team, or one nation. It concerns the standards that should apply to every athlete participating in the World Cup tournament.
Imagine the precedent. If host countries may exclude key players who have not been convicted of any offence, then the competitive balance of a tournament can be altered by immigration decisions rather than footballing performance.
The consequences may extend beyond competitive balance itself. Key players often influence match results, qualification prospects, and progression through a tournament. Where such players are excluded despite having no criminal conviction, tournament outcomes may be influenced by immigration decisions rather than solely by performances on the field.
If a player has been convicted of a serious offence, that is a different matter. But where no conviction exists, fairness requires extreme caution before taking actions that alter the competitive balance of such a global tournament.
The principle at stake is simple: the World Cup should be decided by players, coaches, tactics, preparation, and performance on the field—not by immigration decisions that prevent eligible, unconvicted players from participating.
The World Cup belongs to the world. Its results should be determined on the pitch, not at the border.
